The rules of using Smartest of All.

In short

• Don't use Smartest of All to hurt people, infringe copyrights, or attack the service.
• Subscription tiers renew monthly unless cancelled. Cancel anytime from inside the app or via the billing portal.
• We may pause or end accounts that violate these terms, with notice when possible.
• We provide the service “as is” while we're in early access. Stability and uptime improve over time.

1. Acceptance of terms

By creating an account, accessing, or using the Smartest of All mobile application, website, and related services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of service

Smartest of All is an AI-assisted study platform that lets you create, organize, and review flashcards, notebooks, decks, notes, uploads, and other study content. Features include spaced-repetition scheduling, AI-generated content, tutoring conversations, audio study materials, progress tracking, and optional subscription tiers.

3. Accounts and eligibility

You must provide accurate information when creating an account. You are responsible for keeping your password and credentials secure and for all activity that happens under your account. You must be at least 13 years old, or the minimum age required by the laws of your country, to use the service.

4. Acceptable use

You may use Smartest of All only for lawful purposes. You agree not to:

• upload, generate, or share content that infringes intellectual property rights, privacy rights, or any applicable law;
• use the service to distribute spam, malware, hate speech, harassment, or illegal material;
• attempt to reverse engineer, scrape, abuse API limits, or interfere with the operation of the service;
• share account credentials, impersonate others, or create multiple accounts to circumvent limits or bans.

5. Your content

You retain ownership of the notebooks, decks, cards, notes, uploads, and other content you create or import. You grant Smartest of All a limited license to host, store, process, and display your content solely to operate the service for you.

AI-generated suggestions and outputs are produced for your personal study use. You are responsible for reviewing generated content before relying on it, especially in sensitive domains such as medicine, law, finance, or safety-critical topics.

6. Subscriptions and payments

Smartest of All offers free and paid subscription tiers. Paid tiers are billed through Stripe and renew automatically on a monthly basis unless you cancel before the renewal date.

• You can cancel your subscription at any time through the app or the Stripe billing portal.
• Cancellation stops future charges. You keep paid access until the end of the current billing period.
• Prices may change with reasonable notice before the next renewal.
• We do not process payment card details on our own servers. Checkout is handled on Stripe-hosted pages.

7. Free trial and founder pricing

Promotional or founder pricing may be offered from time to time. Unless stated otherwise, founder locks apply to the specific account and subscription and are not transferable. Trial periods convert to paid subscriptions unless cancelled before the trial ends.

8. Refunds

Refunds are handled in accordance with applicable consumer protection laws. If you believe you are entitled to a refund, contact support with the details of your purchase.

9. Account suspension and termination

We may suspend or terminate your account if you violate these terms, abuse the service, or if required by law. When possible, we will notify you in advance. You may also delete your account at any time; deletion removes your data from active systems according to our Privacy Policy.

10. Intellectual property

The Smartest of All name, logo, visual design, software, and underlying code are owned by us or licensed to us. These terms do not grant you any right to copy, modify, distribute, or create derivative works of the service itself.

11. Disclaimers and limitation of liability

The service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will always be accurate.

To the extent permitted by law, our liability is limited to the amount you paid for the service in the 12 months before the claim, or the equivalent local-currency amount for free accounts.

12. Changes to these terms

We may update these Terms of Service from time to time. Material changes will be communicated through the app or by email. Continued use after the changes take effect means you accept the revised terms.

13. Governing law

These terms are governed by the laws of Brazil. Any disputes will be resolved in the competent courts of São Paulo, Brazil, unless local consumer protection laws require otherwise.
